These Terms of Service ("Terms") govern your use of the Smart Sites Connect website and any services you request or purchase from us, including the Free Website Audit, website and enquiry-system builds, and related ongoing plans. By requesting a Free Website Audit, purchasing a plan, or otherwise using this website, you agree to these Terms.
Smart Sites Connect ("SSC", "we", "us", "our") is an Australian sole trader business (ABN 62 792 115 784) based in Melbourne's south-east, Victoria, providing website and customer-enquiry systems for local businesses. You can contact us at [email protected] or 0485 085 499.
SSC provides website design and build services, local search setup, and enquiry-management tools including missed-call text-back, review-request automation, a unified enquiry inbox, and simple invoicing, delivered through our website and funnel platform (HighLevel/LeadConnector) and, where applicable, payment processing through Stripe. The exact scope of what's included is set out on our Pricing page and confirmed with you before work begins.
The Free Website Audit is offered at no cost and with no obligation to purchase. You provide us with your current website address and, where relevant, a brief description of what you'd like reviewed. We'll respond with our observations. The audit is a general review based on the information you provide and publicly available information about your website — it is not a guarantee of any particular outcome, ranking position, or result, and it is not a substitute for professional technical, legal, or marketing advice.
Current pricing is published on our Pricing page and may be updated from time to time; the price that applies to you is the price confirmed at the time you sign up. As at the date of these Terms, two payment options are available:

Both options include the same features. Setup fees are payable to begin work. Ongoing monthly fees are charged automatically to the payment method you provide, processed securely through Stripe. We do not receive or store your full card details.
Your first monthly charge does not occur until 30 days after your website and enquiry system go live (that is, after you have approved it and we have launched it), giving you time to see the system running before ongoing billing starts. This applies to the monthly subscription fee only; the setup fee (where applicable) is payable to commence the build.
There is no lock-in contract on the monthly plan. You may cancel your ongoing monthly subscription at any time by contacting us at [email protected], with no cancellation fee. Cancellation takes effect at the end of the billing period already paid for; we do not provide refunds for part-used billing periods. Setup fees are non-refundable once work has commenced, except as required by Australian Consumer Law.
We may update our services, features, or pricing from time to time. We'll give existing clients reasonable notice of any change that affects their current plan before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms or pricing for future billing periods.
To deliver your website and enquiry system, we rely on you to provide accurate business information, timely feedback and approvals, and any content, images, or access we reasonably request. Delays in providing these may delay delivery. You're responsible for the accuracy of the information you submit to us, including through the Free Website Audit form and any checkout page.
On full payment of the applicable setup fee, you own the website content specific to your business (your text, images, and branding) that we build for you. SSC retains ownership of the underlying templates, system design, code frameworks, and tools used to build and operate your website and enquiry system, and these remain our intellectual property. You may not resell, sublicense, or reproduce our underlying templates or systems for another business without our written consent.
While we build websites and systems to be found in local search and to capture enquiries effectively, we do not guarantee specific search rankings, enquiry volumes, conversion rates, or business outcomes. Results depend on many factors outside our control, including market conditions, competition, and how the tools we provide are used.
Our website and services rely on third-party providers, including HighLevel/LeadConnector (website, funnel, and enquiry-management platform), Stripe (payment processing), and Cloudflare (security). Your use of these integrated services is also subject to those providers' own terms. We are not responsible for outages, changes, or issues caused by third-party providers that are outside our reasonable control.
To the maximum extent permitted by law, and subject to the Australian Consumer Law protections referred to above, SSC's total liability to you arising out of or in connection with these Terms or the services, however arising, is limited to the total fees you paid to us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special losses, including loss of profits, loss of business, or loss of data, arising from your use of our services.
We may suspend or terminate services if fees remain unpaid after reasonable notice, if you breach these Terms, or if we reasonably believe the service is being used unlawfully or abusively. You may terminate at any time as set out in section 6.
You agree not to use this website in any way that is unlawful, that attempts to gain unauthorised access to our systems, or that interferes with its normal operation. We may update or take down parts of the website at any time.
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria, Australia in relation to any dispute arising from these Terms or our services.
We may update these Terms from time to time to reflect changes to our services or legal requirements. The current version will always be published on our website with its effective date. For existing clients, material changes will be notified as described in section 7.
